Terms of Service

1. Acceptance of Terms

By accessing or using GMC Checker ("the Service"), operated via gmccheck.com and the GMC Checker Shopify app, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

GMC Checker is a compliance auditing tool that crawls publicly accessible e-commerce websites and evaluates them against Google Merchant Center requirements. The Service provides:

  • Automated website crawling and content analysis
  • AI-powered compliance evaluation against GMC policies
  • Compliance reports with scores and actionable recommendations
  • Fix suggestions including policy templates and page content
  • Google Merchant Center account status monitoring (with OAuth consent)
  • Ongoing compliance monitoring via the Shopify app

3. Accounts and Access

One-Time Checks

One-time compliance checks do not require an account. You provide a URL and email address, pay the check fee, and receive a report via email. Reports are accessible via a unique, secret URL.

Shopify App

The Shopify app requires a Shopify store and an active subscription. By installing the app, you authorize us to access your store data as described in our Privacy Policy. You are responsible for maintaining the security of your Shopify account.

4. Pricing and Payment

  • One-time checks — charged per check at the price displayed at the time of purchase, processed via Polar.sh.
  • Shopify app — billed monthly through Shopify Billing at the current subscription price. Includes a free trial period.

All fees are non-refundable except where required by law. We reserve the right to change pricing with 30 days notice.

5. Acceptable Use

You agree not to:

  • Use the Service to scan websites you do not own or have authorization to scan.
  • Attempt to circumvent rate limits, security measures, or access controls.
  • Reverse engineer, decompile, or disassemble the Service.
  • Use the Service to compete directly with GMC Checker.
  • Submit malicious URLs or attempt to compromise our crawling infrastructure.
  • Resell, redistribute, or sublicense access to the Service.

6. Compliance Reports

Our compliance reports are generated using AI analysis and automated checks. While we strive for accuracy:

  • Reports are advisory only and do not guarantee Google Merchant Center approval.
  • AI analysis is non-deterministic — results may vary slightly between scans of the same website.
  • Some pages (checkout, password-protected areas) may not be accessible to our crawler.
  • Google's policies change over time. We update our rules regularly but cannot guarantee real-time accuracy.

7. Fix Suggestions and Templates

The Service may generate policy templates, page content, and fix suggestions for your store. These are provided as starting points and:

  • Should be reviewed and customized before use.
  • Are not legal advice — consult a legal professional for compliance with local laws.
  • Are applied at your own discretion and risk when using the auto-fix features.

8. Google Merchant Center Integration

If you connect your Google Merchant Center account via OAuth, you authorize us to read your account status and product data. You can revoke this access at any time from within the app. We are not affiliated with or endorsed by Google.

9. Intellectual Property

The Service, including its compliance rules, analysis algorithms, user interface, and branding, is the intellectual property of GMC Checker. Generated reports and fix suggestions are licensed to you for use on your own store.

10. Limitation of Liability

To the maximum extent permitted by law, GMC Checker shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Google Merchant Center account suspensions or rejections.
  • Inaccuracies in compliance reports or fix suggestions.
  • Loss of revenue or business opportunity resulting from reliance on our reports.
  • Service interruptions, data loss, or security breaches.

Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may stop using the Service at any time by uninstalling the Shopify app or simply not using the website.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance. For material changes, we will provide notice via email or in-app notification.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.
